WHEREAS, the Metropolitan Council previously approved Agreement No. 140167, by and between the Tennessee Department of Transportation ("TDOT") and the Metropolitan Government of Nashville and Davidson County (Metro), acting by and through the Metropolitan Nashville Public Works Department (now the Nashville Department of Transportation and Multimodal Infrastructure, "NDOT") through resolution, RS2014-1245; and,
WHEREAS, pursuant to the terms described in Agreement No. 140167, dated October 27, 2014, the estimated fifty percent cost share for Metro for the miscellaneous safety improvements was $191,050.00; and,
WHEREAS, Amendment 1, attached hereto, deletes the language in Exhibit A of Agreement No. 140167, dated October 27, 2014, and replaces it with the new Exhibit A, attached; and,
WHEREAS, due to the increase in the estimated project cost from $382,100.00 to $1,408,611.00 shown in Exhibit A, Metro's fifty percent estimated cost share is now $704,305.51; and,
WHEREAS, Metro has deposited $175,250.00 of the current fifty percent Metro cost share to TDOT leaving a cost share balance due of $529,055.51.01; and,
WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes The Metropolitan Government of Nashville & Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,
