WHEREAS, the Metropolitan Council previously approved Agreement No. 140167, by and between the Tennessee Department of Transportation (“TDOT”) and the Metropolitan Government of Nashville and Davidson County (Metro), acting by and through the Metropolitan Nashville Public Works Department (now the Nashville Department of Transportation and Multimodal Infrastructure, “NDOT”) through resolution, RS2014-1245; and,

WHEREAS, pursuant to the terms described in Agreement No. 140167, dated October 27, 2014, the estimated fifty percent cost share for Metro for the miscellaneous safety improvements was $191,050.00; and,

WHEREAS, Amendment 1, attached hereto, deletes the language in Exhibit A of Agreement No. 140167, dated October 27, 2014, and replaces it with the new Exhibit A, attached; and,

WHEREAS, due to the increase in the estimated project cost from $382,100.00 to $1,408,611.00 shown in Exhibit A, Metro’s fifty percent estimated cost share is now $704,305.51; and,

WHEREAS, Metro has deposited $175,250.00 of the current fifty percent Metro cost share to TDOT leaving a cost share balance due of $529,055.51.01; and, 

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes The Metropolitan Government of Nashville & Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is in the interest of The Metropolitan Government of Nashville & Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Amendment 1 to the Agreement between the State of Tennessee, Tennessee Department of Transportation and the Metropolitan Government of Nashville and Davidson County, through the Nashville Department of Transportation and Multimodal Infrastructure, attached hereto as Exhibit 1, and incorporated herein by reference, is hereby approved, and that the Metropolitan Mayor is authorized to execute the same.

Section 2.                       Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3.                     That this resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville & Davidson County requiring it.

This resolution approves Amendment 1 to an agreement between the Tennessee Department of Transportation (“TDOT”) and the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) previously approved by Resolution No. RS2014-1245.

 

RS2014-1245 approved the agreement for miscellaneous safety improvements at the Old Hickory Boulevard intersection with Central Pike. The improvements included new signals, signs, pavement markings, ramps, and pedestrian upgrades. Pursuant to the terms of this agreement, Metro’s share of the costs was equal to $191,050, representing 50% of the estimated project cost.

 

This resolution approves an amendment to update Exhibit A of the agreement related to the project cost. The project cost has increased from $382,100 to $1,408,611. Metro’s 50% share of the estimated cost has increased to $704,305.51.

 

Fiscal Note: This amendment increases the estimated project cost from $382,100 to $1,408,611 and the fifty percent cost share for Metro is now $704,305.51. Metro has deposited $175,250 of the current fifty percent cost share to TDOT leaving a balance due of $529,055.51.
