A resolution approving an Intergovernmental Agreement by and between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, acting through the Nashville Department of Transportation and Multimodal Infrastructure, and CSX Transportation, Inc, for resurfacing from West of Harpeth Valley Road to East of Hillwood Boulevard, State Project No: 19S001-S2-003, Federal Project No: HSIP-1(456). WHEREAS, the State of Tennessee, Department of Transportation ("TDOT") plans to undertake Project Pin Number 131263.00, resurfacing from West of Harpeth Valley Road to East of Hillwood Boulevard, ("Highway Project"); and,
WHEREAS, METRO agrees to cooperate with Railroad in constructing the Highway Project, and to assume ownership and the responsibility to maintain the Highway Project as described in the Railroad Agreement attached hereto and incorporated herein as Exhibit 1; and,
WHEREAS, Railroad agrees to cooperate with TDOT and METRO in the construction and maintenance of the Highway Project; and,
WHEREAS, it is in the best interest of The Metropolitan Government of Nashville and Davidson County that this resurfacing be carried out.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the intergovernmental agreement by and between the State of Tennessee, Department of Transportation and the Metropolitan Government of Nashville and Davidson County, through the Department of Transportation and Multimodal Infrastructure, and CSX Transportation, Inc., attached hereto as Exhibit A and incorporated herein by reference, for resurfacing from West Harpeth Valley Road to East of Hillwood Boulevard, State Project No: 19S001-S2-003, Federal Project No: HSIP-1(456), is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
