WHEREAS, the Emergency Communications District for Nashville and Davidson County ("ECD") was established pursuant to Tennessee law to secure for and provide to the public more efficient emergency service in the form of Enhanced 911 services; and,
WHEREAS, the Metropolitan Government ("Metro") has contracted for services to replace 'End of Life' 800MHZ Radio Equipment in use by Metro's public-safety agencies; and,
WHEREAS, the replacement 800MHZ Radio Equipment will significantly improve the scope and efficiency of the 911 services provided to the residents of Davidson County; and,
WHEREAS, ECD has the powers of a municipality under Tennessee law by virtue of Tennessee Code Annotated section 7-86-106 and has agreed to assist the Metropolitan Government in financing the replacement of the 800MHZ Radio Equipment; and,
WHEREAS, Tennessee Code Annotated section 12-9-101, et seq. grants Tennessee municipalities the authority to enter into interlocal agreements to operate common projects and achieve common objectives subject to the approval of their respective governing bodies or otherwise as provided by law; and,
WHEREAS, Metro has calculated the cost of the Radio Equipment will be over $5,000,000 and will expend approximately $1,000,000 per year; and,
WHEREAS, the Board of the Emergency Communications District has agreed to assist in the financing of the 800MHz Radio Equipment by reimbursing Metro One Million Dollars ($1,000,000) for five consecutive fiscal years beginning January 1, 2021 and reoccurring annually on January 1, 2021, January 1, 2022, January 1, 2023, January 1, 2024 and January 1, 2025, in an amount not to exceed Five Million Dollars ($5,000,000).
