WHEREAS, the Emergency Communications District for Nashville and Davidson County (“ECD”) was established pursuant to Tennessee law to secure for and provide to the public more efficient emergency service in the form of Enhanced 911 services; and,

WHEREAS, the Metropolitan Government (“Metro”) has contracted for services to replace ‘End of Life’ 800MHZ Radio Equipment in use by Metro’s public-safety agencies; and,

WHEREAS, the replacement 800MHZ Radio Equipment will significantly improve the scope and efficiency of the 911 services provided to the residents of Davidson County; and,

WHEREAS, ECD has the powers of a municipality under Tennessee law by virtue of Tennessee Code Annotated section 7-86-106 and has agreed to assist the Metropolitan Government in financing the replacement of the 800MHZ Radio Equipment; and,

WHEREAS, Tennessee Code Annotated section 12-9-101, et seq. grants Tennessee municipalities the authority to enter into interlocal agreements to operate common projects and achieve common objectives subject to the approval of their respective governing bodies or otherwise as provided by law; and,

WHEREAS, Metro has calculated the cost of the Radio Equipment will be over $5,000,000 and will expend approximately $1,000,000 per year; and,

WHEREAS, the Board of the Emergency Communications District has agreed to assist in the financing of the 800MHz Radio Equipment by reimbursing Metro One Million Dollars ($1,000,000) for five consecutive fiscal years beginning January 1, 2021 and reoccurring annually on January 1, 2021, January 1, 2022, January 1, 2023, January 1, 2024 and January 1, 2025, in an amount not to exceed Five Million Dollars ($5,000,000).

WHEREAS, it is in the best interest of the Metropolitan Government that the Interlocal Agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.  That the Interlocal Agreement, attached hereto and incorporated herein, by and between The Metropolitan Government of Nashville and Davidson County and the Emergency Communications District for Nashville and Davidson County ("ECD"), whereby ECD will assist the Metropolitan Government in financing replacement 800MHz Radio Equipment by reimbursing Metro One Million Dollars ($1,000,000) annually, in an amount not to exceed Five Million Dollars ($5,000,000), is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the Information Technology Services Department shall be appropriated $1,000,000 per fiscal year for five (5) fiscal years beginning in fiscal year 2020 for a total appropriation of $5,000,000.

Section 3.  That the Emergency Communications District for Nashville and Davidson County will reimburse the Metropolitan Government One Million Dollars ($1,000,000) for five consecutive fiscal years beginning January 1, 2021 and reoccurring annually on January 1, 2021, January 1, 2022, January 1, 2023, January 1, 2024 and January 1, 2025, in an amount not to exceed Five Million Dollars ($5,000,000).

Section 4. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Agenda Analysis

This resolution approves an interlocal agreement between Metro and the Emergency Communications District (ECD) for the partial funding of replacement 800MHz emergency radio equipment used by public safety agencies. Pursuant to the agreement, ECD will reimburse Metro $1,000,000 the first of each year for the next five years starting January 1, 2021. The agreement may be terminated by either party with 90 days’ notice.

 

T.C.A. §12-9-101, et seq., allows municipalities to participate with other local governmental entities through interlocal agreements approved by the local legislative body.

 

Fiscal Note: Metro’s cost of the 800MHZ Radio Equipment replacement is calculated to be over $5,000,000. Emergency Communications District will reimburse Metro an annual reimbursement of $1,000,000 for the next five years starting January 1, 2021.
