WHEREAS, to improve an unappealing and blank TDOT retaining wall located at 264 Old Hickory Boulevard, NDOT has proposed to TDOT to install a mural designed and created by high school artists on the wall (the "Bellevue Mural"); and,
WHEREAS, pursuant to TDOT rules governing "transportation art", NDOT must provide a resolution approved by the Metropolitan Council in support of the proposed project as part of its application for the Bellevue Mural; and,
WHEREAS, the plans attached hereto as "Exhibit A" provide the concept and maintenance plans for the Bellevue Mural; and,
WHEREAS, NDOT's application for a license agreement with TDOT for the conveyance of interest of surplus TDOT right-of-way is attached hereto as "Exhibit B"; and,
WHEAREAS, Tennessee Code Annotated ? 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into agreements with the State by resolution; and,
WHEREAS, it is in the best interest of the Metropolitan Government of Nashville and Davidson County that this beautification project is supported and that the license agreement is approved.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the conceptual plan for the proposed Bellevue Mural project, attached hereto as "Exhibit A" and incorporated herein, is hereby supported by the Metropolitan Council.
