An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, to enter into an agreement with Fisk University, to provide improved green stormwater infrastructure through the construction of a green roof (Project No. SWGR 2022086190 and Proposal Number 2025M-026AG-001).

WHEREAS, the Metropolitan Department of Water and Sewerage Services ("METRO") owns and operates a combined sewer system located in the Schrader basin with combined flow directed to the Central Water Reclamation Facility and a combined sewer outfall during heavy rain conditions; and,
WHEREAS, METRO is under a consent decree that requires the reduction of stormwater into its combined sewer system; and,
WHEREAS, green infrastructure, such as green roofs, is an effective strategy to reduce the volume of stormwater discharged into sewer systems, recognized under section 15.64.010 of the Metropolitan Code; and,
WHEREAS, under Tennessee Code Annotated 7-35-401, green roofs are considered a sewerage system that may be implemented on both public and private property; and,
WHEREAS, pursuant to the terms of the participation agreement, attached hereto as Exhibit 1, Fisk University ("FISK"), in compliance with all Metropolitan Government of Nashville and Davidson County ("METRO") requirements and specifications, will contract and oversee the construction of a green roof on their new Allied Science Building, as shown in Exhibit 2 hereto attached, Stormwater Grading Permit 2022086190; and,
WHEREAS, METRO will inspect the construction and upon acceptance, FISK will be responsible for ongoing operation and maintenance; and,
WHEREAS, FISK agrees to design and install educational signage at the Allied Science Building to describe the benefits of the green roof and METRO's participation; and,
