An ordinance amending Chapter 4.12 of the Metropolitan Code of Laws to change the qualifications for certain solid waste collection and disposal contracts to be approved by the Metropolitan Council.

WHEREAS, the Procurement Code of the Metropolitan Government of Nashville and Davidson County requires that the Metropolitan Council approve solid waste collection and disposal contracts that contain an annual contract amount of $500,000; and
WHEREAS, the threshold annual contract value was established thirty-one years ago in Ordinance No. O94-966, adopted by the Metropolitan Council on May 17, 1994; and
WHEREAS, based on inflation calculations, $500,000 in 1994 is equivalent to approximately $1.06 million in 2025 dollars; and
WHEREAS, it is fitting and proper that the threshold annual contract value requiring approval by the Metropolitan Council be increased to one million dollars.
NOW THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Section 4.12.220 is hereby amended by deleting the section in its entirety and replacing it with the following:
No contract providing for the collection, transportation and/or disposal of solid waste, whether temporary or permanent, which contracts provide for annual payment of one million dollars or more, including unit price contracts, may be entered into unless and until such contract has been approved by resolution duly adopted by the council by twenty-one affirmative votes.
Section 2. This Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
