An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent and temporary easements through negotiation, condemnation and acceptance, for the Hillwood and Wilsonia WIR Project, for two properties located at 114 Hillwood Boulevard and Harding Pike (unnumbered) (Project No. 24-WG-0003 and Proposal No. 2025M-059ES-001).

WHEREAS, the negotiation, condemnation and acceptance of permanent and temporary easements, for two properties located at 114 Hillwood Boulevard and Harding Pike (unnumbered), are also needed to construct MWS Project No. 24-WG-0003; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2025M-059ES-001 on May 1, 2025, for the negotiation, condemnation and acceptance of permanent and temporary easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate, condemn, and accept permanent and temporary easements for two properties located at 114 Hillwood Boulevard and Harding Pike (unnumbered), as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiation, condemnation and acceptance authorized by this ordinance.
Section 3. All necessary and incidental cost of the temporary and permanent easements herein authorized to be accepted shall be paid from funds authorized from Fund No. 47335 WIR/Capital Plan #128.
Section 4. Amendments to this legislation shall be approved by resolution.
