An ordinance approving a greenway participation agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through the Board of Parks and Recreation and Department of Water and Sewerage Services, and Jeff Zeitlin for the construction of certain greenway improvements. WHEREAS, the Metropolitan Government of Nashville and Davidson County (“Metro”), by and through the Board of Parks and Recreation, maintains certain property as part of the Metro greenway system; and,
WHEREAS, a portion of the greenway has been constructed upon property owned by Metro, by and through the Department of Water and Sewerage Services, consisting of approximately 2.6 acres of property located at 1508 3rd Avenue North (Map/Parcel No. 08205012700); and,
WHEREAS, the parties have negotiated the terms of a participation agreement that will authorize Jeff Zeitlin to construct improvements within a portion of the Greenway and will be responsible for the ongoing care and maintenance of the improvements; and,
WHEREAS, approval of the participation agreement will benefit the citizens of Nashville and Davidson County.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the participation agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through the Board of Parks and Recreation and the Department of Water and Sewerage Services, and Jeff Zeitlin for the construction of greenway improvements attached hereto and incorporated herein, is hereby approved.
Section 2. Amendments to this ordinance may be approved by resolution.
Section 3. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
