An ordinance amending Chapter 4.12 of the Metropolitan Code of Laws to change the qualifications for certain sole source contracts to be approved by the Metropolitan Council.

WHEREAS, the Procurement Code of the Metropolitan Government of Nashville and Davidson County requires that the Metropolitan Council approve sole source contracts that contain a total contract value of $250,000; and

 

WHEREAS, the threshold contract value was established twelve years ago in Ordinance No. 2013-338, adopted by the Metropolitan Council on February 5, 2013; and

 

WHEREAS, based on inflation calculations, $250,000 in 2013 is equivalent to approximately $340,000 in 2025 dollars; and

 

WHEREAS, the Metropolitan Council finds that increasing the threshold contract amount to $350,000 will account for the inflationary increase that has occurred.

 

NOW THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

 

Section 1. That subsection 4.12.060.C is hereby amended by deleting the section in its entirety and replacing it with the following:

 

C. Notwithstanding the foregoing, no sole source contract for the purchase of goods or services, excluding contracts for economic development initiatives and services, with a total contract amount in excess of three hundred fifty thousand dollars may be entered into unless and until such contract has been approved by resolution duly adopted by the council by twenty-one affirmative votes.

 

Section 2. This Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
