WHEREAS, pursuant to Metropolitan Code of Laws § 5.04.120, the Metropolitan Council can approve donations, exclusive of donations of real estate, by resolution; and

WHEREAS, In-N-Out Burger owns and plans to develop a parcel of property (the “Property”) at 1900 Gallatin Pike N, Madison, TN; and

WHEREAS, infrastructure improvements (the “Improvements”) in the vicinity of that intersection will eventually be necessary as the Property and nearby properties develop; and

WHEREAS, as provided in the letter attached as Exhibit 1, the In-N-Out Burger proposes to donate $300,000.00 to the Metropolitan Government as a contribution towards Improvements.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. In-N-Out Burger proposed donation of $300,000.00 towards the cost of the Improvements, as proposed in Exhibit 1, is approved.

Section 2. This Resolution shall take effect immediately upon its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

The Council is authorized to approve donations by resolution pursuant to Metropolitan Code of Laws § 5.04.120(B).
