WHEREAS, the Metropolitan Government owns certain parcels of property as shown in Section 1 below; and,
WHEREAS, Section 7-3-314(e) of the Tennessee Code Annotated (the "Act") permits a metropolitan government by resolution of its governing body to authorize the conveyance of the real property acquired pursuant to a delinquent tax sale by grant to a nonprofit organization; and,
WHEREAS, on February 6, 2019, the Metropolitan Council passed Resolution RS2019-1570, which granted 15 parcels of property to The Housing Fund, Inc. to establish Nashville's first Community Land Trust and develop affordable or workforce housing via a development agreement; and,
WHEREAS, RS2019-1570 required the properties be developed for affordable housing within five years from the passage of the Resolution or the property reverted back to the Division of Public Property; and,
WHEREAS, The Housing Fund, Inc. successfully developed four of the properties for the purpose of affordable housing; and
WHEREAS, The Housing Fund, Inc. was unable to obtain title and develop 11 of the properties for affordable housing within 5 years, therefore the properties reverted back to the Division of Public Property; and,
WHEREAS, on February 25, 2025, the Metropolitan Housing Trust Fund Commission voted to re-grant five of the properties, listed in Section 1, to The Housing Fund, Inc. for the Community Land Trust to develop affordable housing; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that the conveyance of property be approved for the Community Land Trust.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
