WHEREAS, the State of Tennessee, Department of Transportation ("TDOT") has programmed safety funds for the improvement of various railroad crossings throughout Davidson County; and,
WHEREAS, TDOT has partnered with The Metropolitan Government of Nashville and Davidson County ("Metro"), acting by and through its Department of Transportation and Multimodal Infrastructure, to construct a Highway-Railroad Crossing Separation Project at the Sadler Avenue CSX Railroad LM .103, State Project No: 19CIT-F3-003, Federal Project No: HSIP-R00S(550), PIN 132029.00; and,
WHEREAS, train traffic has blocked the crossing, which acts as the only point of vehicle ingress/egress into the neighborhood, on multiple occasions for over an hour in the past year leaving residents no way to exit or enter their neighborhood which was established prior to the rail line; and,
WHEREAS, the blockages have caused Metro Nashville residents to miss work, healthcare appointments, and have the potential to impact emergency services; and,
WHEREAS, the project estimate is $7,129,900.00 in which the total cost is to be split $800,000.00 for Metro, $1,265,980.00 for CSX, and $5,063,920.00 for TDOT through the Federal Highway Administration Section 130 Railway-Highway Crossings Program; and,
WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes The Metropolitan Government of Nashville and Davidson County to approve an agreement with TDOT by resolution; and,
