A resolution approving Amendment 3 to an intergovernmental agreement by and between the Tennessee Department of Transportation ("TDOT") and the Metropolitan Government, acting by and through the Nashville Department of Transportation and Multimodal Infrastructure ("NDOT"), for the construction of a sidewalk on Harding Place (State Route 255), from Danby Drive to Nolensville Pike. WHEREAS, the Metropolitan Council previously approved Agreement No. 150028 ("the Agreement"), by and between the Tennessee Department of Transportation ("TDOT") and the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department (now the Nashville Department of Transportation and Multimodal Infrastructure, "NDOT") through resolution, RS2015-1534; and,
WHEREAS, Amendment Number 1 to the Agreement, approved by RS2020-513, replaced in its entirety, the language of the Agreement dated August 14, 2015, with the language of the Amendment 1; and,
WHEREAS, Amendment Number 2 to the Agreement, approved by RS2022-1388, extended the completion date of the project from March 1, 2022 to January 31, 2025, to allow time for right-of-way acquisition; and,
WHEREAS, as set forth in Amendment Number 3 to the Agreement, attached hereto and incorporated herein, the parties wish to extend the completion date to August 28, 2028; and,
WHEREAS, Tennessee Code Annotated ? 12-9-104(a)(2)(b) authorizes the Metropolitan Council to approve an agreement with TDOT by resolution; and,
WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that Amendment Number 3 to the Agreement be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
