WHEREAS, the Metropolitan Government, acting by and through the General Sessions Court, previously entered into a grant agreement with the U.S. Department of Justice to implement a DUI Court to serve participants convicted of a misdemeanor DUI offense approved by RS2022-1397, RS2023-2364 amendment one and RS2023-43 amendment two; and,
WHEREAS, amendment three to the grant agreement extends the grant period by 12 months to September 30, 2026, allows the remaining grant funding of $142,442 to be utilized during FY 2026, allows indirect cost rates to be recalculated to accurately reflect grantor requirements, and incorporates the cash match of $62,625 to meet the grantor’s 25 percent match of the total award, a copy of which amendment three is attached hereto; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that amendment three be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That amendment three to the Adult Drug Court and Veterans Treatment Court Discretionary Program grant by and between the U. S. Department of Justice and the Metropolitan Government, acting by and through the General Sessions Court, to implement a DUI Court to serve participants convicted of a misdemeanor DUI offense, a copy of which amendment three is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves the third amendment to a grant agreement between the Metropolitan Government and the U.S. Department of Justice, previously approved by Resolution No. RS2022-1397 and amended by RS2023-2364 and RS2023-43. The grant is used to implement a DUI Court to serve participants convicted of a misdemeanor DUI offense.
The first grant amendment, approved by RS2023-2364, reallocated a total of $7,116.35 in unused funding from Year 1 of the grant to Years 2, 3, and 4 of the grant. The additional funding allows court staff to attend state and national conferences to provide training on best practices in treatment and specialty courts and further resource education.
The second grant amendment, approved by RS2023-43, reallocates unused funding from Years 1 and 2 to Years 3 and 4 for Low Intensive Outpatient treatment for substance use disorder.
This proposed grant amendment would extend the grant period to September 30, 2026, and allow the remaining grant funding of $142,442 to be utilized during Fiscal Year 2026. The amendment allows indirect cost rates to be recalculated and accurately reflect grantor requirements. It also incorporates an in-kind local cash match of $62,625.
