WHEREAS, the Metropolitan Department of Water and Sewerage Services (“METRO”) owns and operates a combined sewer system located in the Schrader basin with combined flow directed to the Central Water Reclamation Facility and a combined sewer outfall during heavy rain conditions; and, 

WHEREAS, METRO is under a consent decree that requires the reduction of stormwater into its combined sewer system; and,

WHEREAS, green infrastructure, such as green roofs, is an effective strategy to reduce the volume of stormwater discharged into sewer systems, recognized under section 15.64.010 of the Metropolitan Code; and,

WHEREAS, under Tennessee Code Annotated 7-35-401, green roofs are considered a sewerage system that may be implemented on both public and private property; and,

WHEREAS, pursuant to the terms of the participation agreement, attached hereto as Exhibit 1, Fisk University (“FISK”), in compliance with all Metropolitan Government of Nashville and Davidson County (“METRO”) requirements and specifications, will contract and oversee the construction of a green roof on their new Allied Science Building, as shown in Exhibit 2 hereto attached, Stormwater Grading Permit 2022086190; and,

WHEREAS, METRO will inspect the construction and upon acceptance, FISK will be responsible for ongoing operation and maintenance; and,

WHEREAS, FISK agrees to design and install educational signage at the Allied Science Building to describe the benefits of the green roof and METRO’s participation; and,

WHEREAS, METRO agrees to pay One Hundred Fifty Thousand Dollars ($150,000.00) as a contribution towards this green infrastructure; and, 

WHEREAS, the provision of such improved green stormwater infrastructure is deemed to benefit both parties and the general community.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1.                     The participation agreement (Exhibit 1) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, and Fisk University, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2.                     One Hundred Fifty Thousand Dollars ($150,00.00) is available in Fund No. 47335-SIR to pay One Hundred Fifty Thousand Dollars ($150,00.00) as a maximum contribution towards the Project. In no event will Metro’s contribution exceed that amount.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance authorizes a participation agreement between the Metropolitan Department of Water and Sewerage Services and Fisk University (“Fisk”) to provide improved green stormwater infrastructure through the construction of a green roof.

 

Per the agreement, Fisk would contract and oversee the construction of a 11,440 square foot green roof on its Allied Science Building, which will meet all specifications and requirements in Metro Water’s Stormwater Management Manual. Metro Water has determined that the project will benefit Metro Water’s overall systemic needs and agreed to contribute $150,000 to the project.

 

Metro Water remains under a consent decree that requires the reduction of stormwater into its combined sewer system. The provision of the green stormwater infrastructure would reduce the amount of stormwater directed to the combined sewer system and reduce the potential for localized storm flooding.

 

This legislation has been approved by the Planning Commission. Amendments to this legislation shall be approved by resolution.

 

Fiscal Impact: Metro will pay Fisk University a contribution, not to exceed, $150,000 towards the green infrastructure project.
