WHEREAS, pursuant to Section 6.11 of the Metropolitan Charter, and conditioned upon the request of the Mayor, the Metropolitan Council desires to appropriate funds in the amount of five-hundred thousand dollars ($500,000) from the unencumbered balance of appropriations to the Police, Parks, Library, Nashville Department of Transportation, Health, Planning, Codes, Finance, Metropolitan Council Office, Mayor’s Office, General Services, Human Resources, Department of Law, and Human Relations Commission for the purpose of funding a grant to Planned Parenthood of Tennessee and North Mississippi to provide comprehensive sexual health education in Nashville and Davidson County, and distribution of safer sex supply kits, family planning counseling, birth control counseling, and birth control products.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: That the following amount from the unencumbered balance of appropriations to the Metropolitan Nashville Police Department, Metro Parks and Recreation Department, Nashville Public Library, Nashville Department of Transportation and Multimodal Infrastructure, Metro Public Health Department, Department of Codes and Building Safety, Department of Metropolitan Finance, Planning Department, Mayor’s Office, Metropolitan Councill Office, General Services Department, Metro Human Resources, Department of Law, and Metropolitan Human Relations Commission is hereby appropriated for the purpose of a grant to Planned Parenthood of Tennessee and North Mississippi:

Section 3. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

Analysis
This resolution appropriates the amount of $500,000 from the unencumbered appropriations of the following sources:
• Metro Council - Regular Pay - $100,000
• Mayor’s Office - Regular Pay - $100,000
• Traffic Signal Maintenance Regular Pay -- $300,000
These appropriations will be transferred to a new “Family Planning Services” account to be available for a grant to Planned Parenthood of Tennessee and North Mississippi to provide comprehensive sexual health education in Nashville and Davidson County, distribution of safer sex supply kits, distribution of accurate information about abortion and reproductive health care, and services related to abortion navigation for individuals seeking abortion care in states outside of Tennessee. The new Family Planning Services account is being created by the Department of Finance for this purpose.
This resolution must be deferred to the October 4, 2022, meeting because Section 6.11 of the Metropolitan Charter only permits such appropriation transfers at the end of a fiscal quarter. Section 6.11 specifically authorizes the transfer of the unencumbered balance of an appropriation, by resolution of the Council, within the same section of the budget and within the same fund at the request of the mayor and at the end of any quarter of the fiscal year.
