WHEREAS, GS Rivergate Apartments LLC (“Owner") is developing property located near 300 Connare Drive (Parcel No. 03316028100); and,

WHEREAS, GS Rivergate Apartments LLC proposes to donate a 1.88 acre parcel of property located at 300 Connare Drive (Parcel No. 03316028100); and,

WHEREAS, pursuant to the access and parking easement and participation agreement attached hereto and incorporated herein (the “Participation Agreement”), GS Rivergate Apartments LLC proposes to donate, and the Metropolitan Government proposes to accept an access and parking easement; and,

WHEREAS, pursuant to Tenn. Code Ann. § 66-9-305 and Metropolitan Charter § 2.01, the Metropolitan Government may accept donations of property interests for the purpose of establishing greenways and providing the public with recreational opportunities in natural areas; and,

WHEREAS, it is in the best interest of The Metropolitan Government of Nashville and Davidson County that the property donation, participation agreement and easement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreements attached hereto and incorporated herein are hereby approved, and the Director of Public Property is authorized to execute the same.

Section 2. The Director of Public Property, or his designee, is authorized to accept and record the Agreement and to take such reasonable actions as may be necessary to carry out the intent of this ordinance.

Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville & Davidson County requiring it.

This ordinance approves a donation of a 1.88 acre parcel, an access and parking easement, and a participation agreement between the Metropolitan Boards of Parks and Recreation (“Metro Parks”), and GS Rivergate Apartments, LLC (“Greystar”) for park improvements at 300 Connair Drive.

 

Greystar owns these 1.88 acres and proposes to donate the property to the Metropolitan Government. Tenn. Code Ann. § 66-9-305 and Metropolitan Charter § 2.01, the Metropolitan Government may accept donations of property interests for the purpose of establishing greenways and providing the public with recreational opportunities in natural areas.

 

The access and parking easement would allow Greystar to reserve a driveway access easement upon, over, and across the parcel that would be donated to Metro Parks. A parking easement would also be reserved on the parcel.

 

The participation agreement between Metro Parks and Greystar provides the right for Greystar to enter the parcel to maintain landscaping on the property. Greystar shall keep, maintain, and replace the landscaping in good condition at its own expense.
