A resolution authorizing the transfer and use of a certain appropriation in the Fiscal Year 2026 Operating Budget Ordinance for the benefit of the Nashville Office of Entertainment.

WHEREAS, on June 17, 2025, the Metropolitan Council enacted The Budget Ordinance of the Metropolitan Government of Nashville, Davidson County, Tennessee for Fiscal Year 2026 pursuant to Substitute Ordinance No. BL2025-833 (the “Operating Budget”); and,

WHEREAS, on June 3, 2025, the Metropolitan Council enacted Ordinance No. BL2025-818, which contained language that raised a variety of legal and procedural questions while amending Chapter 2.147 by 1) deleting all references to the Nashville Music, Film, and Entertainment Commission and the Office of Music, Film, and Entertainment, 2) inserting references to the Nashville Entertainment Commission and the Nashville Office of Entertainment, and 3) deleting references to organization within the Mayor's Office; and,

WHEREAS, the Operating Budget contained an appropriation to Account Number 01101637 that, as reflected in the accompanying budget book, is denominated as “Contribute Music and Entertainment Economic Development and Film Initiatives" and intended to fund the Music, Film, and Entertainment Commission, a unit of the Mayor’s Office with no explicit authorization for funding for a newly created Nashville Office of Entertainment; and,

WHEREAS, Section 6.11 of the Metropolitan Charter provides that upon request of the Mayor, the Metropolitan Council may by resolution transfer the unencumbered balance of any appropriation, or any portion thereof, to another appropriation within the same section of the budget and within the same fund.

NOW, THEREFORE BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That the Metropolitan Council hereby finds that the Nashville Entertainment Commission is the successor entity to the Nashville Music, Film, and Entertainment Commission and that the Nashville Office of Entertainment is the successor entity to the Office of Music, Film, and Entertainment.

Section 2.                     That the appropriation to Account Number 01101637 in the Operating Budget shall be deemed transferred and appropriated to Account Number 74101000 - NOE Executive Leadership for the purposes of the Nashville Office of Entertainment for Fiscal Year 2026.

Section 3.                     That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance authorizes the transfer and use of a certain appropriation in the FY2026 Operating Budget Ordinance for the benefit of the Nashville Office of Entertainment.

 

This ordinance follows the passage of Substitute Ordinance No. BL2025-833, the operating budget ordinance, and Ordinance No. BL2025-818, which amended Chapter 2.147 of the Metropolitan Code of Laws to, among other things, rename the Nashville Music, Film, and Entertainment Commission to the Nashville Entertainment Commission; rename the Office of Music, Film, and Entertainment to the Nashville Office of Entertainment; and remove references to organize the Office of Music, Film, and Entertainment within the Mayor's Office.

 

The FY2026 Operating Budget contains an appropriation of $250,000 to Account Number 01101637 that was described “Contribute Music and Entertainment Economic Development and Film Initiatives.” The accompanying FY2026 Budget Book, as well as the FY2025 Budget Book, describes the account as “Music Entertainment Commission.” The appropriation was intended to fund the Music, Film, and Entertainment Commission. The budget appropriation contained no explicit authorization for funding for a Nashville Office of Entertainment or Office of Music, Film, and Entertainment.

 

The ordinance includes a finding that the Nashville Entertainment Commission is the successor entity to the Nashville, Music, Film, and Entertainment Commission and that the Nashville Office of Entertainment is the successor entity to the Office of Music, Film, and Entertainment. The ordinance then deems the appropriation from Account Number 01101637 in the FY2026 Operating Budget as transferred and appropriated to Account Number 74101000 - NOE Executive Leadership for the purposes of the Nashville Office of Entertainment for Fiscal Year 2026.
