Whereas, pursuant to BL2017-1007, the Metropolitan Council approved a lease agreement (the “Lease”) between the Metropolitan Government and the Electric Power Board of the Metropolitan Government of Nashville and Davidson County (“NES”) for a parcel of property (the “Property”) that was the site of the old Due West Landfill; and,

WHEREAS, under the Lease, NES operates a community solar array known as Music City Solar; and,

WHEREAS, pursuant to the proposed amendment (the “Amendment”) to the Lease attached as Exhibit A, the parties propose to permit NES to add battery storage to the solar project and extend the term of the Lease by 10 years; and, 

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that Amendment be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That the proposed amendment to the Lease by and between the Metropolitan Government and the Electric Power Board of the Metropolitan Government of Nashville and Davidson County is hereby approved.

Section 2.                      That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves the first amendment to a lease agreement between the Metropolitan Government and the Electric Power Board relating to the operation of a community solar array on the old Due West Landfill at 801 Due West Avenue.

 

The lease agreement was approved pursuant to Ordinance No. BL2017-1007. The lease agreement is for approximately 10 acres of land at 801 Due West Avenue for the construction and operation of a two-megawatt community solar array called Music City Solar.

 

The proposed amendment would add an additional 5,000 square feet to operate a pilot battery energy storage system. The lease term would also be extended by ten years and expire on November 17, 2052. Under the lease agreement, the Electric Power Board will submit quarterly reports to the Metropolitan Government documenting the battery electric storage system’s technical performance.

 

Fiscal Note: This amendment to the ground lease agreement with Nashville Electric Service (“NES”) adds 5,000 square feet to pilot a battery energy storage system (“BESS”) and ten years to the initial term to extends the agreement’s expiration to November 17, 2052. In recognition of the benefit that Music City Solar would provide for the residents of Metro, the lease would be provided at no cost to NES.
