BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 16.08.012 of the Metropolitan Code of Laws is hereby amended by inserting a new subsection M as follows and renumbering subsequent sections accordingly:

M. Section 2902 of the 2024 Edition of the International Building Code is hereby amended by adding Section 2902.3.7 as follows.

2902.3.7 Diaper changing stations in public toilet facilities. Each floor of a structure with one or more public toilet facilities must include:

1) at least one diaper changing station per floor in a family, assisted-use, or unisex bathroom; or

2) at least one diaper changing station for each sex per floor in a separate-sex restroom.

Section 2. That Section 16.12.130 of the Metropolitan Code is hereby amended by inserting a new subsection H as follows and renumbering subsequent sections accordingly:

H. Section 403 of the 2024 Edition of the International Plumbing Code is hereby amended by adding Section 403.7 as follows:

403.7 Diaper changing stations in public toilet facilities. Each floor of a structure with one or more public toilet facilities must include:

1) at least one diaper changing station per floor in a family, assisted-use, or unisex bathroom; or

2) at least one diaper changing station for each sex per floor in a separate-sex bathroom.

Section 3. That this ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance, as amended, revises Chapter 16.08 and Chapter 16.12 of the Metropolitan Code of Laws to require diaper changing facilities in certain public restrooms.

 

The amended legislation would amend the Metropolitan Government’s building code, which is largely governed by international standards. The bill would require that public toilet facilities include at least one diaper changing station per floor in a family, assisted-use, or unisex bathroom, or at least one diaper changing station for each sex per floor in a separate-sex restroom.

 

Fiscal Note: The estimated average cost to install a diaper changing station in a new facility is $850 per station and in existing facilities is $1,200 per station. According to Metro’s General Services Department, there is a new feature in some designs that include adult changing stations but will be at a significantly higher installation cost.
