An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing public water main, and to accept new public water mains, fire hydrant assembly, sanitary sewer manhole and easements, for property located at Tuggle Avenue (unnumbered), also known as Tuggle SP (MWS Project Nos. 22-WL-144 and 23-SL-112 and Proposal No. 2023M-105ES-001).

WHEREAS, the abandonment of approximately 15 linear feet of existing eight-inch water main (DIP), and the acceptance of approximately 98 linear feet of new six-inch water main (DIP), approximately 276 linear feet of new eight-inch water main (DIP), one fire hydrant assembly, one sanitary sewer manhole and easements, for property located at Tuggle Avenue (unnumbered), also known as Tuggle SP, are needed to construct project numbers 22-WL-144 and 23-SL-112; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-105ES-001 on June 30, 2023, for the abandonment and acceptance of said water mains, fire hydrant assembly, sanitary sewer manhole and easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 15 linear feet of existing eight-inch water main (DIP), and to accept approximately 98 linear feet of new six-inch water main (DIP), approximately 276 linear feet of new eight-inch water main (DIP), one fire hydrant assembly, one sanitary sewer manhole and easements, for property located at Tuggle Avenue (unnumbered), also known as Tuggle SP, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
