WHEREAS, the Metropolitan Government of Nashville and Davidson County, acting through its Department of Parks and Recreation, desires to enter into a license agreement with the State of Tennessee Department of Transportation to use a portion of the Licensed Premises described in Exhibit A attached hereto, to install, operate, and maintain sidewalks, crosswalks, retaining walls and related equipment as part of Phase II of the 440 pedestrian greenway in Davidson County, Tennessee; and,

WHEREAS, the license agreement is attached hereto and incorporated herein; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that the license agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.  The license agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Department of Parks and Recreation, and the State of Tennessee, acting by and through its Commissioner of Transportation, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2.  That any amendments, renewals or extensions of the terms of the license agreement shall be approved by Resolution of the Metropolitan Council receiving at least twenty-one affirmative votes.

Section 3.  This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves an intergovernmental agreement between the Metropolitan Department of Parks and Recreation (“Metro Parks”) and the Tennessee Department of Transportation (“TDOT”) to construct and maintain a multi-use pedestrian greenway at 440 Greenway Phase II.

 

Pursuant to this agreement, TDOT would grant a license to Metro Parks for installation, operation, and maintenance of a greenway as a part of the 440 Greenway project. Metro Parks may only use the space for a public use purpose. The license would be granted at no cost to Metro and would be for a term of 10 years on a renewable basis. Any amendments, renewals or extensions of the terms of the license agreement requires approval by the Metropolitan Council through a resolution receiving at least 21 votes.

 

State law authorizes the Metropolitan Government to enter into intergovernmental agreements with the State of Tennessee by resolution.

 

Fiscal Note: There is no cost to Metro for the performance of this agreement. Metro will be responsible for the maintenance and operation of the Phase II improvements of the 440 Greenway Project.
