An ordinance amending Chapter 17.20 of the Metropolitan Code of Laws to require the Nashville Department of Transportation and Multimodal Infrastructure (NDOT) to complete area transportation infrastructure analyses for certain site plans and rezonings (Proposal No. 2026Z-001TX-001).

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Chapter 17.20 of the Metropolitan Code is hereby amended by adding the following as a new Section 17.20.145:
17.20.145 - Area Transportation Infrastructure Analysis.
A. Purpose. The purpose of an area transportation infrastructure analysis is to evaluate the cumulative impact of multiple recent developments and/or rezonings on the transportation infrastructure and network within the general area of the developments and/or rezonings and to identify what transportation mitigations and infrastructure improvements are needed to mitigate such cumulative impact.
B. Requirements. The Nashville Department of Transportation and Multimodal Analysis (NDOT) shall be required to complete an area transportation infrastructure analysis if at least one of the following is met:
1. An application for a site plan is made for a parcel or group of parcels located along a roadway or at an intersection that has a ‘D’, ‘E’, or ‘F’ level of service as determined by the Tennessee Department of Transportation (TDOT) or NDOT and where the proposed site plan is estimated to increase the number of daily trips along the roadway or through the intersection by 5 percent or more.
2. An application for a site plan is made for a parcel or group of parcels where there are three or more parcels or groups of parcels with site plans that required multimodal transportation analyses approved within the five years preceding the triggering site plan application within a one mile radius of the location of the proposed site plan and where the proposed site plan requires a multimodal transportation analysis.
3. An application for a rezoning is made for a parcel or group of parcels located along a roadway or at an intersection that has a ‘D’, ‘E’, or ‘F’ level of service as determined by the Tennessee Department of Transportation (TDOT) or NDOT and where the proposed change in entitlements created by the change in zoning is estimated to increase the number of daily trips along the roadway or through the intersection by 5 percent or more.
C. Area Transportation Infrastructure Analysis. An area transportation infrastructure analysis shall include the following:
1. An analysis of the existing levels of service for all collector and arterial roadways as shown on the Major and Collector Street Plan and their intersections within a two-mile radius of the location of the proposed site plan or rezoning and the cumulative maximum impact to those roadways’ and intersections’ levels of service from the potential increase in trips generated by the proposed site plan or rezoning and other approved, but unbuilt, site plans and recently rezoned parcels within the two-mile radius area.
2. An analysis of the existing multimodal infrastructure within a two-mile radius of the location of the proposed site plan or rezoning and the cumulative maximum impact to the existing multimodal infrastructure from the maximum potential increase in trips generated by the proposed site plan or rezoning and other approved, but unbuilt, site plans and recently rezoned parcels within the two-mile radius area.
3. Recommendations for transportation mitigations and infrastructure improvements that will mitigate the accumulative impact of the proposed site plan or rezoning and other approved, but unbuilt, site plans and recently rezoned parcels on arterial and collector roadways as shown in the Major and Collector Street Plan, their intersections, and multimodal infrastructure within the two-mile radius area.
D. Implementation of Area Transportation Infrastructure Analysis Recommendations and Findings.
1. The completed area transportation infrastructure analysis shall be shared with the Metropolitan Planning Commission and the district councilmember in whose district the proposed site plan or rezoning is in.
2. NDOT shall update all relevant studies and other ongoing analyses with the findings from the completed area transportation infrastructure analysis, including the Multimodal Master Plan.
3. Transportation mitigations and infrastructure improvements identified by the completed area transportation infrastructure analysis shall be included in subsequent Capital Improvement Budgets.
Section 2. The Metropolitan Clerk is directed to publish a notice announcing such change in a newspaper of general circulation within five days following final passage.
Section 3. This Ordinance shall take effect upon publication of the above said notice, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
