WHEREAS, the United States Congress previously enacted the Workforce Innovation and Opportunity Act, 29 U.S.C.A. § 3101, et seq., (“the Act”) that provides federal funding and is designed to help job seekers access employment, education, training, and support services to succeed in the labor market and match employers with skilled workers; and,

WHEREAS, the Act establishes a framework for governors of the states to establish Local Workforce Development Areas and certify local workforce innovation and opportunity boards to expedite the delivery of services funded under the Act on a reginal basis; and,

WHEREAS, under the authority of the Act, the Governor of Tennessee has previously designated the Northern Middle Tennessee Local Workforce Development Area that consists of the counties of Cheatham, Davidson, Dickson, Houston, Humphreys, Montgomery, Robertson, Rutherford, Stewart, Sumner, Trousdale, Williamson, and Wilson (the “NMTLWDA”), and there has been further established the Northern Middle Tennessee Local Workforce Development Board as the regional entity responsible for the implementation and operation of the workforce development system; and,

WHEREAS, mayors and chief executives of the counties in the NMTLWDA have certain obligations and responsibilities related to the Act and have previously executed an interlocal agreement regarding such obligations and responsibilities; and,

WHEREAS, pursuant to RS2023-131, adopted on December 19, 2023, the Metropolitan Council previously authorized Metropolitan Mayor Freddie O’Connell to execute an interlocal agreement for the Northern Middle Tennessee Local Workforce Development Area, which expired on June 30, 2024; and,  

WHEREAS, due to the expiration of the previous agreement, Metropolitan Mayor Freddie O’Connell is now required to execute a new interlocal agreement that will expire on June 30, 2026; and,

WHEREAS, it is important that the Metropolitan Mayor have the authority to enter into, authorize, and execute agreements as required by the State of Tennessee under the Act.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                       That the interlocal agreement attached as Exhibit A is hereby approved and the Metropolitan Mayor is authorized to execute the same on behalf of the Metropolitan Government, and shall have the further authority to enter into, authorize, and execute agreements as required by the State of Tennessee pursuant to the Workforce Innovation and Opportunity Act.

Section 2.                       That this resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution authorizes the Mayor to execute an interlocal agreement for the Northern Middle Tennessee Local Workforce Development Area in accordance with the Workforce Innovation and Opportunity Act (“WIOA”). WIOA provides federal funding and is designed to help job seekers access employment, education, training, and support services to succeed in the labor market and match employers with skilled workers. The Council has previously approved the acceptance of a WIOA grant pursuant to RS2020-673, which was amended by RS2022-1834. The Mayor was previously authorized to enter into an interlocal agreement for the Northern Middle Tennessee Local Workforce Development Area pursuant to RS2018-1351 and RS2023-131.

 

Under the authority of WIOA, the Governor of Tennessee has previously designated the Northern Middle Tennessee Local Workforce Development Area that consists of the counties of Cheatham, Davidson, Dickson, Houston, Humphreys, Montgomery, Robertson, Rutherford, Stewart, Sumner, Trousdale, Williamson, and Wilson, and there has been further established the Northern Middle Tennessee Local Workforce Development Board as the regional entity responsible for the implementation and operation of the workforce development system.

 

Mayors and chief executives of the counties in the Northern Middle Tennessee Local Workforce Development Area are being asked to execute an intergovernmental agreement regarding their obligations and responsibilities related to WIOA. The agreement begins July 1, 2024, and is valid through June 30, 2026.

 

This resolution authorizes Mayor Freddie O’Connell to execute this agreement, in accordance with state law.
