An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to remove existing sanitary sewer main, to abandon existing sanitary sewer main, sanitary sewer manholes and easements, and to accept new sanitary sewer and water mains, sanitary sewer manholes and easements, for five properties located on Lebanon Pike, also known as Lebanon Pike Apartments (MWS Project Nos. 22-SL-82 and 22-WL-93 and Proposal No. 2022M-150ES-001).

WHEREAS, the removal of approximately 19 linear feet of existing eight inch sanitary sewer main, and the abandonment of approximately 664 linear feet of existing eight inch sanitary sewer main, four sanitary sewer manholes and easements, and the acceptance of approximately 338 linear feet of new eight inch sanitary sewer main (PVC), approximately 399 linear feet of new eight inch sanitary sewer main (DIP), approximately 20 linear feet of new eight inch water main (DIP), eight sanitary sewer manholes and easements, for five properties located on Lebanon Pike, also known as Lebanon Pike Apartments, are needed to construct project numbers 22-SL-82 and 22-WL-93; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-150ES-001 on October 4, 2022, for the removal, abandonment, and acceptance of said sanitary sewer and water mains, sanitary sewer manholes and easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to remove approximately 19 linear feet of existing eight inch sanitary sewer main, to abandon approximately 664 linear feet of existing eight inch sanitary sewer main, four sanitary sewer manholes and easements, and to accept approximately 338 linear feet of new eight inch sanitary sewer main (PVC), approximately 399 linear feet of new eight inch sanitary sewer main (DIP), approximately 20 linear feet of new eight inch water main (DIP), eight sanitary sewer manholes and easements, for five properties located on Lebanon Pike, also known as Lebanon Pike Apartments, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.
Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the removal, abandonment and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance has been approved by the Planning Commission. Future amendments to this ordinance may be approved by resolution.
Fiscal Note: This ordinance has no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
