An ordinance approving a participation agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through the Housing Division of the Metropolitan Planning Department, and Park Center, Inc., to provide enhanced pedestrian mobility and bus shelter improvements for Park Center, Inc.’s proposed development, as well as other existing properties in the area (Proposal No. 2026M-050AG-001).

WHEREAS, the Metro Housing Division established the Connecting Housing to Infrastructure Program (“CHIP”), funded through the Capital Spending Plan (“CSP”) to support enhanced infrastructure improvements related to the development income-restricted affordable housing; and
WHEREAS, Park Center, Inc. (the “Developer”) meets the criteria to receive CHIP funding through providing income-restricted affordable housing and infrastructure improvements; and,
WHEREAS, pursuant to the terms of the participation agreement, attached hereto as Exhibit 1, the Developer, in compliance with all Metropolitan Government of Nashville and Davidson County (“Metro”) requirements and specifications, will contract and oversee the construction of upgraded sidewalk on the West side of Gallatin Pike to the intersection of Gallatin Pike and Broadmoor Avenue to ADA accessibility standards and an upgraded bus shelter and concrete pad on the East side of Gallatin Pike near the intersection of Gallatin Pike and Broadmoor Avenue; and,
WHEREAS, the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) will inspect the construction and upon acceptance, will be responsible for ongoing operation and maintenance; and,
WHEREAS, Metro agrees to pay $164,183.00 as a contribution toward the improvements; and
WHEREAS it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this ordinance be approved.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The participation agreement (Exhibit 1) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Housing Division of the Metropolitan Planning Department, and Park Center, Inc. to upgrade sidewalk on the West side of Gallatin Pike to the intersection of Gallatin Pike and Broadmoor Avenue to ADA accessibility standards upgrade the bus shelter and concrete pad on the East side of Gallatin Pike near the intersection of Gallatin Pike and Broadmoor Avenue is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. That Metro will contribute an amount not to exceed $164,183.00, which is available in Fund No. 40021 and Fund No. 40022.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. The ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance approves a participation agreement between the Housing Division of the Metropolitan Planning Department (“Metro”) and Park Center, Inc., (“Developer”) to provide enhanced pedestrian mobility and bus shelter improvements for the Developer’s proposed development and other existing properties in the area. The participation agreement meets the criteria for the Connecting Housing to Infrastructure Program, as funded through the Capital Spending Plan.
The proposed improvements consist of upgraded sidewalk on the west side of Gallatin Pike to the intersection of Broadmoor Avenue and an upgraded bus shelter and pad on the east side of Gallatin Pike near the intersection of Gallatin Pike and Broadmoor Avenue. Pursuant to the participation agreement, the Developer would contract and oversee construction of this project and comply with Metro requirements and specifications.
The Nashville Department of Transportation and Multimodal Infrastructure will inspect the construction and, upon acceptance, will be responsible for ongoing operation and maintenance of the pedestrian signaling. Metro will pay $164,183 toward these improvements, payable on a reimbursement basis.
This ordinance has been approved by the Planning Commission. Future amendments to this ordinance may be approved by resolution.
Fiscal Note: Metro will contribute up to $164,183 for the sidewalk upgrade on west side of Gallatin Pike to the intersection of Gallatin Pike and Broadmoor Avenue and bus shelter and pad upgrade on the east side of Gallatin Pike near the intersection of Gallatin Pike and Broadmoor Avenue near the Park Center, Inc.’s proposed affordable housing project located at 1095 Gwynn Drive.
