WHEREAS, the abandonment of approximately 62 linear feet of existing eight inch sanitary sewer main and easement, and the acceptance of approximately 106 linear feet of new eight inch sanitary sewer main (DIP), three sanitary sewer manholes and easement, for property located at 3104 Gallatin Pike, are needed to construct project number 22-SL-24; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-061ES-001 on April 11, 2022, for the abandonment and acceptance of said sanitary sewer mains, sanitary sewer manholes, and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 62 linear feet of existing eight inch sanitary sewer main and easement, and accept approximately 106 linear feet of new eight inch sanitary sewer main (DIP), three sanitary sewer manholes and easement, for property located at 3104 Gallatin Pike, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance has been approved by the Planning Commission. Future amendments to this ordinance may be approved by resolution.

 

Fiscal Note: This ordinance has no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
