WHEREAS, pursuant to Mayor Freddie O’Connell’s Executive Order No.41, the urban tree canopy is a recognized utility, managed as an asset with tree protection and expansion programs. Pursuant to Section 2.01(8) of its Charter, the Metropolitan Government of Nashville and Davidson County adorns its streets, roads, alleys, and walkways with trees; and

WHEREAS, the Metropolitan Government conducts landscaping activities, including the planting and maintenance of trees, through the Department of Water and Sewerage Services (“Metro Water Services”) and other departments of the Metropolitan Government; and

WHEREAS, Metro Water Services provides for the installation and maintenance of trees within the public right-of-way and coordinates Metropolitan Tree Policy within Nashville and Davidson County, Tennessee; and

WHEREAS, Murfreesboro Pike (U.S. Highway 41) is a major highway throughfare serving the southeast sector of Davidson County, Tennessee; and

WHEREAS, Metro Water Services and the Tennessee Department of Transportation (TDOT) wish to improve the appearance and functionality of this segment of Murfreesboro Pike with landscaping, including the planting of appropriate tree species, pursuant TDOT Landscape Design Guidelines; and

WHEREAS, pursuant to a proposed landscaping plan, Metro Water Services desires to plant 158 trees composed of 18 individual species within the public right-of-way spaces along this highway thoroughfare; and

WHEREAS, a copy of the TDOT Landscaping Permit establishing the terms of agreement between TDOT and the Metropolitan Water and Sewerage Services Department is attached hereto as Exhibit 1; and

WHEREAS, Tennessee Code Annotated § 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into agreements with the State by resolution; and

WHEREAS, it is in the best interests of the Metropolitan Government and the citizens of Davidson County that the Metropolitan Council support this proposed landscaping plan.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.   The Metropolitan Council hereby approves the agreement between the Metropolitan Department of Water and Sewerage Services and the Tennessee Department of Transportation (TDOT) for a proposed landscaping project on Murfreesboro Pike (U.S. Highway 41) between Vultee Boulevard and Town Park Drive, attached hereto and incorporated herein by reference.

Section 2.   This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves an agreement between the Metropolitan Department of Water and Sewerage Services (“MWS”) and the Tennessee Department of Transportation (“TDOT”) for a landscaping project on Murfreesboro Pike between Vultee Boulevard and Town Park Drive.

 

The agreement provides that MWS will install 56 trees along Murfreesboro Pike, which is a road owned by the state of Tennessee. Landscaping work will begin February 1, 2026, and conclude by March 31, 2026. MWS will be responsible for the maintenance of these trees.

 

MWS must provide proof of adequate and appropriate general liability insurance providing coverage in an amount not less than $1,000,000 dollars per occurrence and $300,000 per claiming naming the State of Tennessee as an insured party.

 

Fiscal Note: Metropolitan Department of Water and Sewerage Services will provide for the installation and maintenance of 56 trees within the public right-of-way along the north and south sides of 1161 to 1691 Murfreesboro Pike.
