WHEREAS, the relocation of a water pressure reducing valve into a proposed underground vault, and the construction of approximately 45 linear feet of new six inch water main (DIP) and appurtenances, for property located at 5646 Amalie Drive, are needed to construct project number 21-WG-90; and,

WHEREAS, the negotiation, condemnation and acceptance of temporary and permanent easements, for property located at 5646 Amalie Drive, is needed to construct project number 21-WG-90; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2021M-086ES-001 on November 1, 2021, for the relocation of a water pressure reducing valve, construction of public water main, and acquisition of temporary and permanent easements through negotiation, condemnation, and acceptance.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to relocate a water pressure reducing valve into a proposed underground vault, to construct approximately 45 linear feet of new six inch water main (DIP) and appurtenances, and to negotiate, condemn, and accept temporary and permanent easements, for property located at 5646 Amalie Drive, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the relocation, construction, and negotiation, condemnation and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
