WHEREAS, Section 7-3-314 of the Tennessee Code Annotated states that metropolitan forms of government may provide financial assistance to nonprofit organizations in accordance with the guidelines of the Metropolitan Government; and,

WHEREAS, Section 5.04.070 of the Metropolitan Code of Laws provides that the Council may, by Resolution, appropriate funds for the financial aid of nonprofit organizations; and,

WHEREAS, Metropolitan Charter Section 10.104 provides that the Board of Health has the duty to contract for such services as will further the program and policies of the Board, subject to confirmation by Resolution of Council; and,

WHEREAS, Resolution No. RS2026-1871 approved a grant award of $1,311,652 from the U.S. Department of Health and Human Services to the Metropolitan Board of Health to provide for the prevention, surveillance, diagnosis, and treatment of HIV/AIDS; and,

WHEREAS, Resolution No. RS2026-2154 approved a grant award of $3,185,496 from the U.S. Department of Health and Human Services to the Metropolitan Board of Health to provide for the prevention, surveillance, diagnosis, and treatment of HIV/AIDS; and,

WHEREAS, the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, wishes to appropriate funding and contract with We Are One Recovery to provide early intervention services, housing services, mental health services, psychosocial services, and transportation services for participants in the Ryan White Part A program; and, 

WHEREAS, it is to the benefit of the citizens of the Metropolitan Government of Nashville and Davidson County that the funds are appropriated and the contract approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     There is hereby appropriated Two Hundred Seventy Six Thousand Two Hundred and Four Dollars ($276,204) from the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to We Are One Recovery for the purposes herein stated.

Section 2.                       The Metropolitan Government is hereby authorized to enter into a grant contract, attached hereto and incorporated herein, with We Are One Recovery for the amount provided herein and the purposes stated. 

Section 3.                       That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution appropriates a total of $276,204 from the Metropolitan Board of Health to We Are One Recovery for the provision of services to participants in the Ryan White Part A program.

 

According to the related grant agreement, We Are One Recovery would provide early intervention services, housing services, mental health services, psychosocial services, and transportation services.

 

The related grant agreement would commence on the date filed with the Metropolitan clerk after receiving all required approvals. The grant contract would end on February 28, 2027. A similar grant contract for similar services was approved by the Metropolitan Council through Resolution No. RS2025-1634 and expired February 28, 2026. It is understood that the We Are One Recovery provided services prior to the commencement of the term of this agreement. While the Metropolitan Government is not obligated via this agreement for services in the interim period between the grants, recipient will be allowed to submit invoices and be paid for services rendered beginning March 1, 2026.

 

Tenn. Code Ann. section 7-3-314 authorizes the Metropolitan Government to provide financial assistance to nonprofit organizations. Section 5.04.070 of the Metropolitan Code of Laws provides that the Metropolitan Council may by Resolution appropriate funds for the financial aid of nonprofit organizations.
