WHEREAS, Section 4.12.060 of the Metropolitan Code of Laws authorizes the Metropolitan Purchasing Agent to enter into sole source contracts when the Purchasing Agent determines in writing according to standards adopted by the Procurement Standards Board that there is only one source for the supply or services required; and,
WHEREAS, the Purchasing Agent has determined that the services and supplies to be provided by American Red Cross meet the requirements for the use of a sole source contract; and,
WHEREAS, Section 4.12.060 of the Metropolitan Code of Laws calls for Council approval by Resolution of sole source contracts “with a total contract amount in excess of three hundred fifty thousand dollars ($350,000.00)”; and,
WHEREAS, approval of the Contract will benefit the citizens of Nashville and Davidson County.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: That the Contract between The Metropolitan Government of Nashville and Davidson County and American Red Cross, attached hereto and incorporated herein, is hereby approved.
Section 2: That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves a sole source contract between the Metropolitan Government of Nashville and Davidson County and American Red Cross to provide licensed training services for the Nashville Fire Department.
Sole source contracts may be awarded when it is determined that there is only one source for the supply or services rendered. Section 4.12.060 of the Metropolitan Code requires all sole source contracts having a total value in excess of $350,000 to be approved by the Metropolitan Council by a resolution receiving 21 affirmative votes.
The estimated value of this contract is $500,000 and therefore requires Council approval. The contract term will begin once signed by all parties and filed in the Metro Clerk’s office. The contract term extends for 60 months.
According to the sole source request form, only two vendors could provide the required CPR cards and training materials. The other supplier was unwilling to agree to contract terms. The American Red Cross is the only supplier willing to work with Metro Procurement rules.
Fiscal Note: The estimated contract value of this sole source contract number C6000138 with American Red Cross for licensed training services is $500,000 to be paid from Fund 10101, Cost Center 1032114710.
