A resolution approving an intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County, by and through the Nashville Department of Transportation and Multimodal Infrastructure ("NDOT"), and the State of Tennessee, by and through its Commissioner of Transportation ("TDOT"), for the installation, operation, and maintenance of transportation art on the south side of Mulberry Street, along an I-40 overpass solid retaining wall.

WHEREAS, RS2024-695 approved NDOT's application for a license agreement with TDOT for beautification of a TDOT noise barrier located at Mulberry Street and 6th Avenue South ("the Project"), and supported the conceptual plan for the Project; and,
WHEREAS, the parties desire to enter into an agreement granting NDOT permission to install, operate, and maintain the Project, subject to certain conditions, as set forth in the license agreement attached hereto as "Exhibit A;" and,
WHEAREAS, Tennessee Code Annotated ? 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into agreements with the State by resolution; and,
WHEREAS, it is in the best interest of the Metropolitan Government of Nashville and Davidson County that the intergovernmental agreement be approved.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the intergovernmental agreement between the Metropolitan Government, by and through the Nashville Department of Transportation and Multimodal Infrastructure, and the State of Tennessee, by and through its Commissioner of Transportation, for the installation, operation, and maintenance of transportation art on the south side of Mulberry Street, along an I-40 overpass solid retaining wall, attached hereto as "Exhibit A" and incorporated herein by reference, is hereby approved and the Metropolitan Mayor is authorized to execute the same.
