A resolution supporting beautification of a noise barrier located at Mulberry Street and 6th Avenue South and approving an application for a license agreement between the Metropolitan Government of Nashville and Davidson County, by and through the Nashville Department of Transportation and Multimodal Infrastructure (NDOT), and the State of Tennessee Department of Transportation (TDOT).

WHEREAS, to improve an unappealing and blank roadway structure by incorporating greenery and neighborhood-specific artwork, NDOT has proposed to paint a mural on a TDOT I-40 noise barrier, located at Mulberry Street and 6th Avenue South (the “Mulberry Street Mural”); and,
WHEREAS, pursuant to TDOT rules governing “transportation art”, NDOT must provide a resolution passed by the Metropolitan Council in support of the proposed project during the application process; and,
WHEREAS, the plans attached hereto as “Exhibit A” provide the concept for the Mulberry Street Mural; and,
WHEREAS, NDOT’s application for a license agreement with TDOT for the conveyance of interest of surplus TDOT right-of-way is attached hereto as “Exhibit B”; and,
WHEREAS, Tennessee Code Annotated § 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into agreements with the State by resolution; and,
WHEREAS, it is in the best interest of the Metropolitan Government of Nashville and Davidson County that this beautification project is supported and that the license agreement is approved.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the conceptual plan for the proposed “Mulberry Street Mural” project, attached hereto as “Exhibit A” and incorporated herein, is hereby supported by the Metropolitan Council.
Section 2. That the application for a license agreement between the Metropolitan Government, acting by and through NDOT, and the State of Tennessee Department of Transportation is hereby approved, and the Metropolitan Government is authorized to enter into a license agreement with TDOT for this purpose.
Section 3. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution supports the beautification of a noise barrier at Mulberry Street and 6th Avenue South. The resolution also approves an application for a license agreement between the Tennessee Department of Transportation (“TDOT”) and the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”). The project requested by NDOT would create a “Pie Town” mural and incorporate greenery on the noise barrier along Mulberry Street.
TDOT rules require a resolution of support to accompany an application for a state license agreement for Transportation Art painted in TDOT’s highway features. Proposals for Transportation Art must be requested and submitted by the local government and cannot be submitted by non-governmental entities. The local government must also enter into a license agreement with TDOT. A maintenance plan from the Nashville Department of Transportation for the mural project is attached to the resolution.
