WHEREAS, Ordinance No. BL2022-1094, approved March 3, 2022, authorized the acceptance of approximately 333 linear feet of new eight-inch sanitary sewer main (PVC) and five sanitary sewer manholes, for property located at 806 16th Avenue North, also known as the Lofts at Marathon; and,

WHEREAS, the acceptance of an additional approximately seven linear feet of new sanitary sewer main (updated material), approximately 113 linear feet of steel casing pipe, and one additional sanitary sewer manhole, for property located at 806 16th Avenue North, also known as the Lofts at Marathon, is needed to construct Project No. 21-SL-143; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-006ES-002 on February 20, 2024, for revisions to the original mandatory referral; and,

WHEREAS, Ordinance No. BL2022-1094 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Ordinance No. BL2022-1094 is hereby amended deleting section 1 in its entirety and replacing it with the following:

The Metropolitan Government of Nashville and Davidson County is authorized to accept approximately 172 linear feet of new eight-inch sanitary sewer main (PVC), approximately 168 linear feet of new eight-inch sanitary sewer main (DIP), approximately 113 linear feet of steel casing pipe, and six sanitary sewer manholes, for property located at 806 16th Avenue North, also known as the Lofts at Marathon, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acceptance authorized by this resolution.

Section 3.                     This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

BL2022-1094 provides that amendments to the ordinance may be approved by resolution.

 

The resolution under consideration amends BL2022-1094 to accept approximately seven linear feet of additional new sanitary sewer main (updated material), approximately 113 linear feet of additional steel casing pipe, and one additional sanitary sewer manhole for property located at 806 16th Avenue North, also known as the Lofts at Marathon.

 

These changes have been approved by the Planning Commission.
