WHEREAS, Ordinance No. BL2022-1096, approved March 3, 2022, authorized the abandonment and removal of approximately 389 linear feet of existing six inch water main, and the acceptance of approximately 408 linear feet of new eight inch water main (DIP) and one fire hydrant assembly, for property located at 804 14th Avenue North; and,

WHEREAS the acceptance of approximately 102 linear feet of steel casing pipe, is needed to construct Project No. 21-WL-21; and,

WHEREAS, the abandonment of approximately 112 linear feet of existing six-inch water main, and the acceptance of approximately 86 linear feet of new eight inch water main and one fire hydrant assembly, are no longer needed to construct Project No. 21-WL-21; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-010ES-002 on February 29, 2024, for revisions to the original mandatory referral; and,

WHEREAS, Ordinance No. BL2022-1096 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Ordinance No. BL2022-1096 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:

The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 277 linear feet of existing six--inch water main, and to accept approximately 322 linear feet of new eight-inch water main (RJDIP) and approximately 102 linear feet of steel casing pipe, for property located at 804 14th Avenue North, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.

Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Ordinance No. BL2022-1096 was approved by the Council on March 3, 2022, and authorized the abandonment and removal of approximately 389 linear feet of existing six-inch water main and the acceptance of approximately 408 linear feet of new eight-inch water main (DIP) and one fire hydrant assembly for property located at 804 14th Avenue North. BL2022-1096 provides that amendments to the ordinance may be approved by resolution.

 

The resolution under consideration amends BL2022-1096 to accept 102 linear feet of steel casing pipe. The resolution further removes the abandonment of approximately 112 linear feet of existing six-inch water main, and the acceptance of approximately 86 linear feet of new eight-inch water main and one fire hydrant assembly.

 

These changes have been approved by the Planning Commission.
