WHEREAS, the Metro Nashville Police Department (MNPD) is charged with maintaining safe streets, guaranteeing public safety, and investigating crimes in Nashville; and,

WHEREAS, vehicles that have come into police custody through various circumstances, including but not limited to, abandonment, theft, and violations of Metro codes and ordinances are temporarily stored at a tow-in-lot operated by MNPD; and,

WHEREAS, providing the Chief of Police with authority to establish the administrative fees charged in connection with storage of vehicles at the tow-in-lot is in the best interest of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN GOVERNMENT OF NASHVILLE & DAVIDSON COUNTY:

Section 1.  That the Metropolitan Code of Laws Section 12.72.020 shall be replaced and amended as follows:

                     The Chief of Police shall establish, by rules and regulations, the procedures for the operation of the tow-in lot and fix the methods of collecting storage charges. The Chief of Police shall also establish the rates of administrative fees related to operation of the tow-in lot. The rates of administrative fees set by the Chief of Police shall be published for public viewing at the tow-in lot and a copy filed with the Metropolitan Clerk.  Amendments to the rates shall similarly be published and filed. Such rates shall be no higher than necessary to cover the Metropolitan Government’s costs of operating the tow-in-lot on an annual basis.

Section 2. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance amends Section 12.72.020 of the Metropolitan Code to authorize the Chief of the Metropolitan Nashville Police Department to establish administrative fees for the police-operated tow-in lot.

 

Under current law, the Chief of Police is authorized to establish, by rules and regulations, the procedures for operating the tow-in lot and fix the methods of collecting storage charges.

 

In addition to the current law, the ordinance under consideration authorizes the Chief of Police to set the rates of administrative fees, as approved by the Finance Director. The fees cannot be higher than necessary to cover the costs of operating the tow-in-lot on an annual basis. The fees and any amendments would be available to the public at the tow-in lot and filed with the Metropolitan Clerk.
