WHEREAS, the abandonment of approximately 1,982 linear feet of existing 60-inch sanitary sewer force main (PCCP) and easements, and the acceptance of approximately 2,157 linear feet of new 60-inch sanitary sewer force main (STL) and easements, for six properties located at Victory Avenue, South 1st Street, Shelby Avenue, Titans Way, Russell Street, and Woodland Street, also known as the Browns Creek Force Main Sewer Relocation Project, are needed to construct project number 23-SL-54; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-088ES-001 on June 20, 2023, for the abandonment and acceptance of said sanitary sewer force mains and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 1,982 linear feet of existing 60-inch sanitary sewer force main (PCCP) and easements, and to accept approximately 2,157 linear feet of new 60-inch sanitary sewer force main (STL) and easements, for six properties located at Victory Avenue, South 1st Street, Shelby Avenue, Titans Way, Russell Street, and Woodland Street, also known as the Browns Creek Force Main Sewer Relocation Project, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Future amendments to this legislation may be approved by resolution. This ordinance has been approved by the Planning Commission.

 

Fiscal Note: This ordinance has no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
