WHEREAS, the Metropolitan Council previously adopted and approved Agreement No. 2001226, by and between TDOT and the Metropolitan Government, acting by and through the Former Metropolitan Nashville Public Works Department, now known as NDOT, through Ordinance, BL2001-721, on June 27, 2001; and
WHEREAS, Amendment 1 to Agreement No. 2001226, approved through Resolution, RS2004-597, on November 17, 2004, changed the scope of work listed in Section 2 of Agreement No. 2001226 to include design along with construction, and changed paragraph 4 to anticipate between 15-20 miles of arterial coverage be achieved under this project; and
WHEREAS, the parties wish to amend Agreement No. 2001226 to replace the entire contract with the contract attached hereto as Exhibit A, and incorporated herein, to provide for TDOT's participation in the Project and to state the terms and conditions as to the manner in which the Project will be completed; and
WHEREAS, the Project consists of the planning and design of a fiber optics communications backbone along certain corridors detailed in Exhibit A, along with signal detection, data collection, and CCTV installation along the corridors, which consist of a combined approximately 40 traffic signals over approximately 8.9 miles; and
WHEREAS, it is deemed to be in the best interests of the Metropolitan Government to approve Amendment 2 so that NDOT may resume work...
