A resolution to enable the Metropolitan Government of Nashville and Davidson County to accept third-party inspections subject to adoption and enactment of state law in Title 68 Chapter 120.

WHEREAS, the area of the Metropolitan Government of Nashville and Davidson County is suffering from a housing crisis, like other jurisdictions across the country; and
WHEREAS, HB 296/SB 723 (the “State Bill”) is legislation designed to address a backlog of inspections across the state of Tennessee by allowing third-party inspections by professional engineers, subject to local approval; and
WHEREAS, HB 296 passed the House of Representatives 91-0; and
WHEREAS, the Senate companion SB 723 is set to be heard on the Senate floor on April 19, 2023 beginning at 1:30 p.m.; and
WHEREAS, the State Bill enables local jurisdictions the opportunity to provide for certain third-party inspections subject to adoption by resolution of the local legislative body’s approval; and
WHEREAS, if the State Bill does not become law, this resolution is of no force or effect.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County hereby elects to adopt or opt-in to the provisions of HB 296/SB 723. If the provisions of HB 296/SB 723 fail to become law, this resolution shall have no force or effect.
Section 2. That this resolution shall take effect upon HB296/SB723 becoming law, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
