WHEREAS, the abandonment of approximately 191 linear feet of existing eight-inch sanitary sewer main (PVC), approximately 40 linear feet of 15-inch sanitary sewer main (PVC) and easements, and the acceptance of approximately 1,262 linear feet of new eight-inch water main (DIP), approximately 517 linear feet of new eight-inch sanitary sewer main (PVC), three fire hydrant assemblies, two sanitary sewer manholes and easements, for two properties located at 4154 Murfreesboro Pike and Maxwell Road (unnumbered), also known as Oliveri Phase 1, are needed to construct project numbers 22-WL-75 and 22-SL-158; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-042ES-001 on March 20, 2023, for the abandonment and acceptance of said water and sewer mains, fire hydrant assemblies, sanitary sewer manholes and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 191 linear feet of existing eight-inch sanitary sewer main (PVC), approximately 40 linear feet of 15-inch sanitary sewer main (PVC) and easements, and to accept approximately 1,262 linear feet of new eight-inch water main (DIP), approximately 517 linear feet of new eight-inch sanitary sewer main (PVC), three fire hydrant assemblies, two sanitary sewer manholes and easements, for two properties located at 4154 Murfreesboro Pike and Maxwell Road (unnumbered), also known as Oliveri Phase 1, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Future amendments to this legislation may be approved by resolution. This ordinance has been approved by the Planning Commission.

 

Fiscal Note: This ordinance has no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
