WHEREAS, on March 27th and 28th, 2021, the County experienced historic rain and flash flooding in Zip Code 37211. As a result, in May of 2022, there was a Presidential Disaster Declaration resulting in the award of $8,518,000 in Community Development Block Grant - Disaster Recovery (CDBG-DRGR) funds to assist in long-term recovery efforts; and

 

WHEREAS, federal register notices describing terms for the use of the CDBG-DR funds provided that funds be spent in the Most Impacted and Distressed (MID) area which was identified in a separate memorandum to be ZIP Code 37211; and

 

WHEREAS, by Resolution R94-1326, the Metropolitan Council designated the Metropolitan Development and Housing Agency ("MDHA") as the lead agency responsible for the preparation of the Five-Year Consolidated Plan for Housing and Community Development for The Metropolitan Government of Nashville and Davidson County; and

 

WHEREAS, to access the CDBG-DR funds, HUD directed Grantees to prepare an Action Plan (AP), to allocate the funds to eligible activities/projects; and

 

WHEREAS, the CDBG-DR Action Plan allocates funds to the following activities:

                     $7,666,200 -Activities associated with the development of Affordable Housing and mitigation features incorporated into the affordable housing development during the design phase based on factors such as site location, facility layout/design, cost among other factors. CDBG-DR funds will be used to make grants and/or loans to entities to pay for costs associated with the development of affordable housing, a minimum of 70 % which will benefit Low-to-Moderate Income (LMI) households.

                     $851,800 - Planning and Grant Management.

 

WHEREAS, in accordance with MDHA's HUD-approved Citizen' Participation Plan, a virtual public hearing was held on January 31, 2023, and an in-person public hearing on February 16, 2023, at Casa Azafran located in the MID at 2195 Nolensville Pike, Nashville, TN 32711 to gain input for the Action Plan; and consulted with disaster-affected citizens, stakeholders in the MID, government agencies, and other affected parties to develop the Action Plan which was released for a 30-day public comment which opened on January 25, 2023, and closed on February 25, 2023; and

 

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

 

Section 1. The Metropolitan Council adopts the CDBG-DR Action Plan attached hereto and made part of this Resolution, and the Metropolitan Mayor is authorized to submit the Action Plan to HUD; and

 

Section 2. That the Nashville-Davidson CDBG-DR Action Plan, which describes the use of CDBG-DR funds to develop affordable housing in the 37211 Zip Code which was designated as the MID, with a minimum of 70% of the units benefitting LMI households, is attached hereto and made a part of this Resolution.

 

Section 3. That the Metropolitan Development and Housing Agency is authorized to administer the Consolidated Plan on behalf of the Metropolitan Government of Nashville and Davidson County; and.

 

Section 4. That this Resolution shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution authorizes the Metropolitan Mayor to submit the Nashville-Davidson Community Development Block Grant - Disaster Recovery (CDBG-DR) Action Plan. In May 2022, there was a Presidential Disaster Declaration that resulted in the award of $8,518,000 in CDBG-DR funds to assist in long-term recovery efforts related to the historic rain and flash flooding on March 27 and 28, 2021. The funds must be spent in the Most Impacted and Distressed (“MID”) area, which has been identified as the 37211 zip code.

 

The Metropolitan Development and Housing Agency (“MDHA”) is the lead agency responsible for the preparation of the Five-Year Consolidated Plan for Housing and Community Development for the Metropolitan Government.

 

In order to access the CDBG-DR funds, the Department of Housing and Urban Development (“HUD”) has directed grantees to prepare an Action Plan to allocate the funds to eligible activities and projects. The CDBG-DR Action Plan allocates funds to the following activities:

A total of $7,666,200 would be allocated for activities associated with the development of Affordable Housing and mitigation features incorporated into the affordable housing development during the design phase based on factors such as site location, facility layout/design, cost, and other factors. The funds will be used to make grants and/or loans to entities to pay for the costs associated with the development of affordable housing, a minimum of 70% will benefit low-to-moderate income households. $851,800 would be allocated for planning and grant management.

 

MDHA, in accordance with its HUD-approved Citizen Participation Plan, held a virtual public hearing on January 31, 2023 and an in-person public hearing on February 6, 2023 at Casa Azafran, located within the MID. The 30-day public comment period opened on January 25, 2023 and closed on February 25, 2023.
