An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing public sanitary sewer main, sanitary sewer manholes, fire hydrant assembly and easement, and to accept new public sanitary sewer main, sanitary sewer manholes and fire hydrant assembly, for property located at 2212 12th Avenue South (MWS Project Nos. 22-SL-176 and 22-WL-87 and Proposal No. 2023M-023ES-001).

WHEREAS, the abandonment of approximately 404 linear feet of existing eight-inch sanitary sewer main, two sanitary sewer manholes, one fire hydrant assembly and easement, and the acceptance of approximately 423 linear feet of new eight-inch sanitary sewer main (PVC), three sanitary sewer manholes, and one fire hydrant assembly, for property located at 2212 12th Avenue South, are needed to construct project numbers 22-SL-176 and 22-WL-87; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-023ES-001 on February 16, 2023, for the abandonment and acceptance of said sanitary sewer mains, sanitary sewer manholes, fire hydrant assemblies and easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 404 linear feet of existing eight-inch sanitary sewer main, two sanitary sewer manholes, one fire hydrant assembly and easement, and to accept approximately 423 linear feet of new eight-inch sanitary sewer main (PVC), three sanitary sewer manholes, and one fire hydrant assembly, for property located at 2212 12th Avenue South, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
