WHEREAS, Parks maintains certain property as part of the Metro greenway system; and,
WHEREAS, a portion of the greenway has been constructed upon property owned by the Metropolitan Government of Nashville and Davidson County ("Metro") located at 914 2nd Avenue North (Parcel No. 08214009300); and,
WHEREAS, 1000 2nd Ave N, LP owns certain parcels of real property located at 900 2nd Ave N (Parcel No. 08214000600) and 1000 2nd Avenue North (Parcel No. 08214009000); and,
WHEREAS, pursuant to the participation agreement attached hereto as Exhibit A, 1000 2nd Ave N, LP, proposes to construct improvements within a portion of the Greenway at no cost to the Metropolitan Government and to be responsible for ongoing care and maintenance of such improvements; and,
WHEREAS, it is in the best interest of The Metropolitan Government of Nashville and Davidson County that this participation agreement be approved.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Participation Agreement is hereby approved, and the Director of Parks and Recreation is authorized to execute the same.
Section 2. Any amendments, renewals, or extension of the terms of the Participation Agreement may be approved by resolution of the Metropolitan Council.
Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville & Davidson County requiring it.
