WHEREAS, Ordinance No. BL2021-683, approved April 20, 2021, authorized the abandonment of approximately 223 linear feet of existing eight inch sanitary sewer main, one sanitary sewer manhole and easements, and the acceptance of approximately 3,917 linear feet of new eight inch sanitary sewer main (PVC), approximately 583 linear feet of new eight inch sanitary sewer main (DIP), 29 sanitary sewer manholes and easements, for five properties located on Neely's Bend Road, also known as Fox Valley subdivision;

WHEREAS, Project No. 19-SL-182 now refers to Fox Valley Phase 1; and,

WHEREAS, the previously approved acceptance of approximately 2,598 linear feet of new eight inch sanitary sewer main (PVC), 583 linear feet of new eight inch sanitary sewer main (DIP), 19 sanitary sewer manholes and easements, for three properties located on Neely’s Bend Road, are no longer needed to construct Project No. 19-SL-182; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-007ES-001 on February 2, 2023, for the addition of phasing and amendment of Map and Parcel information and abandonment and acceptance of said sanitary sewer mains, sanitary sewer manholes, and easements.

WHEREAS, Ordinance No. BL2021-683 provides that amendments to the legislation shall be approved by resolution.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1.                     That Ordinance No. BL2021-683 is hereby amended deleting section 1 in its entirety and replacing it with the following:

The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 223 linear feet of existing eight inch sanitary sewer main, one sanitary sewer manhole and easements, and to accept approximately 1,319 linear feet of new eight inch sanitary sewer main (PVC), 10 sanitary sewer manholes, and easements, for two properties located at 1133 and 1201 Neely's Bend Road, now known as Fox Valley Subdivision Phase 1, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.

Section 3.                     This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution amends Ordinance No. BL2021-683 to add phasing, update the map and parcel information, and accept approximately 1,319 linear feet of new eight-inch sanitary sewer main (PVC), 10 sanitary sewer manholes, and easements, for two properties located at 1133 and 1201 Neely's Bend Road, now known as Fox Valley Subdivision Phase 1.

 

This resolution has been approved by the Planning Commission. Ordinance No. BL2021-683 provided that future amendments to the ordinance may be made by resolution.

 

Fiscal Note: This ordinance has no cost to Metro. Donated easements have no market value according to the Department of Metro Water Services.
