WHEREAS, the Metropolitan Government of Nashville and Davidson County, through Metro Water Services (“METRO”), owns property consisting of approximately 0.136 acres located at 6681 Nolensville Pike (Map 181-00 Parcel 102), also known as Tract 46, and 6655 Nolensville Pike (Map 181-00 Parcel 6), also known as Tract 51 (together known as the “Property”), described in Exhibits 1 and 2, attached hereto and incorporated herein; and,

WHEREAS, METRO proposes to donate the Property to the State of Tennessee for use in construction at S.R. 11, US-31A, Nolensville Road from South of Burkitt Road near S. R. 254, Old Hickory Boulevard, State Project No. 19028-2242-14, Federal Project No. NH-11 (80), PIN No. 105766.01; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2023M-002PR-001, to donate said property for use in construction at S.R. 11, US-31A, Nolensville Road from South of Burkitt Road near S. R. 254, Old Hickory Boulevard, State Project No. 19028-2242-14, Federal Project No. NH-11 (80), PIN No. 105766.01.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Director of Public Property, or his designee, is hereby authorized to donate to the State of Tennessee, via quitclaim deeds in substantial form as attached Exhibits 1 and 2, real property consisting of approximately 0.136 acres located at 6681 Nolensville Pike and 6655 Nolensville Pike for use in construction at S.R. 11, US-31A, Nolensville Road from South of Burkitt Road near S. R. 254, Old Hickory Boulevard, State Project No. 19028-2242-14, Federal Project No. NH-11 (80), PIN No. 105766.01, and to execute such documents necessary to carry out this conveyance.

Section 2.                     That easements are herein retained by the Metropolitan Government of Nashville and Davidson County, its agents, servants, and/or contractors and utility companies operating under the franchise from the Metropolitan Government for the right to enter, construct, operate, maintain, repair, rebuild, enlarge and patrol its now existing or future utilities, including drainage facilities, together with their appurtenances, and to do any and all things necessary and incidental thereto.

 

Section 3.                     That in the event there is proposed any construction over, above or under said existing utilities, that said construction shall have the approval of the Director of Water and Sewerage Services, together with the approval of other pertinent departments of the Metropolitan Government or other governmental agency, including the Nashville Electric Service.

Section 4.                     Amendments to this legislation shall be approved by resolution.

Section 5.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance authorizes the Director of Public Property to donate to the State of Tennessee, via quitclaim deeds, approximately 0.136 acres of real property located at 6681 Nolensville Pike and 6655 Nolensville Pike for use in construction at Nolensville Road from South of Burkitt Road near Old Hickory Boulevard. The ordinance also provides that all easements will be retained by the Metropolitan Government. Any proposed construction over, above, or under existing utilities would require the approval of the Director of Water and Sewerage Services, along with any other relevant departments or agencies, including the Nashville Electric Service.

 

Future amendments to this legislation may be approved by resolution.
