WHEREAS, the Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation, seeks to enter into an intergovernmental agreement for the repairing of existing pavement failures and resurfacing of 0.660 miles of Old Hickory Boulevard, from Bridge over I-40 to Bell Road; State Project No. 19SAR1-S8-010, PIN: 128722; and,

WHEREAS, pursuant to the terms of the agreement attached hereto, the total cost estimate of the project is $717,600.00, 75% of which will be funded by the State, and 25%, or $179,400.00, of which will be funded by Metro, subject to the availability of funding from Metro; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes The Metropolitan Government of Nashville & Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is in the best interest of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That the Intergovernmental Agreement by and between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, acting by and between the Nashville Department of Transportation, attached hereto as Exhibit A and incorporated herein by reference, is hereby approved, and that the Metropolitan Mayor is authorized to execute the same.

Section 2.                      That the Metropolitan Government of Nashville and Davidson County’s participation is subject to the availability of funds as determined by the Department of Finance.

Section 3.                       Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 4.                     That this resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville & Davidson County requiring it.

This resolution approves an agreement between the Tennessee Department of Transportation (“TDOT”) and the Nashville Department of Transportation (“NDOT”) for the repairing of existing pavement failures and resurfacing of 0.660 miles of Old Hickory Boulevard, from the bridge over I-40 to Bell Road. The total cost estimate is $717,600. Seventy-five percent, or $538,200, will be funded by TDOT and twenty-five percent, or $179,400, will be funded by NDOT. The term of this agreement begins upon the last date of signature and will extend until November 30, 2024. After completion of the project, the Metropolitan Government will assume ownership and responsibility for maintenance of the project.

 

T.C.A. § 12-9-104 authorizes the approval of intergovernmental agreements with the State of Tennessee by resolution.

 

Fiscal Note: The Metropolitan Government will contribute twenty-five percent of the total cost of the project. Metro’s estimated contribution is $179,400.
