An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing public water main and easements, and to accept new public water main, for properties located at 1233E Lischey Avenue and 1300 North 5th Street, also known as Starlet East Townhomes (MWS Project No. 22-WL-102 and Proposal No. 2022M-185ES-001).

WHEREAS, the abandonment of approximately 415 linear feet of existing eight-inch water main (DIP) and easement, and the acceptance of approximately 12 linear feet of new eight-inch water main (DIP), for properties located at 1233E Lischey Avenue and 1300 North 5th Street, also known as Starlet East Townhomes, are needed to construct project number 22-WL-102; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-185ES-001 on December 16, 2022, for the abandonment and acceptance of said water mains and easement.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 415 linear feet of existing eight-inch water main (DIP) and easement, and to accept approximately 12 linear feet of new eight-inch water main (DIP), for properties located at 1233E Lischey Avenue and 1300 North 5th Street, also known as Starlet East Townhomes, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
