WHEREAS, the abandonment of approximately 605 linear feet of existing three inch water main, and the acceptance of approximately 613 linear feet of new eight inch water main (DIP), approximately 317 linear feet of new eight inch sewer main (PVC), one fire hydrant assembly, and five sanitary sewer manholes, for property located at 1016 and 1016 B West Trinity Lane, also known as West Trinity Townhomes, are needed to construct project numbers 22-WL-67 and 22-SL-141; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-169ES-001 on November 30, 2022, for the abandonment and acceptance of said water and sanitary sewer main, fire hydrant assembly, and sanitary sewer manholes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 605 linear feet of existing three inch water main, and to accept approximately 613 linear feet of new eight inch water main (DIP), approximately 317 linear feet of new eight inch sewer main (PVC), one fire hydrant assembly, and five sanitary sewer manholes, for property located at 1016 and 1016 B West Trinity Lane, also known as West Trinity Townhomes, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Fiscal Note: This ordinance has no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
